ANZ Bank NZ says if a court rules against it in a class action fees case by deciding exception fees paid by customers are void as a penalty, something the bank denies, then ANZ itself has incurred loss and damage and wants an inquiry into the size of that loss.

Documents filed with the High Court have laid out the basis of allegations that ANZ Bank has charged its customers millions of dollars in unfair fees.

The group suing ANZ over "excessive" fees on behalf of some of the bank's customers has listed four causes of action in its statement of claim, arguing "exception" fees in contracts were set by ANZ "diktat", and that publicly available information suggests the cost of such fees to banks is substantially less than the actual fees charged.
